Short terms for this website. Your signed agreement always controls the relationship.
1. Acceptance
Pacific MedicoLegal, a California medico-legal practice management company, operates this site. "We" means Pacific MedicoLegal. "You" means the person using the site and any organization on whose behalf you act.
Use of this site means you accept these terms. Terms shown at the point of access also govern secure areas and secure links.
2. What This Website Is and Is Not
This site describes our work for physicians and how attorneys and claims professionals request an evaluation. That covers everything these pages do.
Nothing here gives medical advice. No page assesses any person clinically. For a medical concern, consult a licensed clinician treating you.
Nothing here gives legal advice. References to statutes, deadlines, and fee schedules stay general, may lag recent amendments, and replace no licensed attorney. We are not a law firm.
No physician-patient relationship forms here. A medical-legal evaluation serves a legal or administrative purpose rather than a treatment purpose, and the evaluating physician does not become your treating physician.
A request creates no engagement. A form, email, voicemail, or fax opens a request and nothing more. We reserve no appointment and open no matter until we confirm by writing. Rely on no deadline before that confirmation arrives. We may decline any request.
3. Permitted and Prohibited Use
You may read this site, contact us, submit the requests this site offers, and print pages for your own or your firm's reference. You agree not to:
- Scrape, Crawl, or Harvest Content by Automated Means
- Probe or Defeat Any Authentication or Access Control
- Send Protected Health Information Through a Public Channel
- Impersonate Anyone or Misstate the Party You Represent
- Introduce Malware or Disrupt the Site
- Use the Site Unlawfully or Against a Court Order
- Republish, Mirror, or Resell Any Part of the Site
We may review suspected violations, block access, preserve records, and report conduct to law enforcement or a regulatory body.
4. Submissions Through This Site
Forms here collect only enough to open a conversation: case numbers, party names, and a way to reach you. They are not built to receive medical records.
Please do not send protected health information through a form, email, or voicemail. Give us the case identifiers and we take the matter from there. We operate under HIPAA, sign a Business Associate Agreement, and send an encrypted upload link once a matter opens. Our security practices and privacy policy cover how we handle records. Transit over a channel you choose travels at your own risk.
Feedback about the site may be used freely and without confidentiality, so route anything confidential through a written agreement. You are responsible for the accuracy of each submission and for the authority to make one.
5. Intellectual Property
Pacific MedicoLegal owns or licenses the text, design, structure, and code of this site. Our name, wordmark, and logo remain our marks, and nothing here grants a license to use them.
You may link to any page and quote a short, attributed excerpt. You may not republish substantial portions, suggest affiliation, or use our material for advertising without written permission. Statutes and government forms remain public documents, and we claim no rights over them.
6. Third-Party Links
We link to outside resources, including government sites. We do not control them and take no responsibility for their content, accuracy, availability, or privacy practices. Once you follow a link, these terms stop applying.
Official sources change without notice. Verify anything you plan to rely on against the current official source.
7. Engagement Terms Control
A separate written agreement governs any actual relationship with us, whether a physician management agreement or the terms covering a specific evaluation or expert witness retention. That agreement sets scope, fees, confidentiality, records handling, liability, termination, and dispute resolution.
Where this page conflicts with a signed agreement between you and us, the signed agreement controls the subject matter covered.
8. Disclaimer of Warranties
We provide this site "AS IS" and "AS AVAILABLE." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the site will remain uninterrupted, secure, or error free.
Descriptions of fees, deadlines, and regulatory requirements stay general and subject to change. Sample figures are neither a quotation nor a promise of earnings. This section limits warranties about the website only.
9. Limitation of Liability
To the fullest extent permitted by law, Pacific MedicoLegal along with our members, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising out of your use of or inability to use this website.
Our total aggregate liability relating to this website will not exceed one hundred dollars ($100). That cap covers the website alone and does not limit our obligations under a signed agreement. Nothing here limits liability for fraud, willful misconduct, or anything else that California law does not allow us to limit.
10. Indemnification
You agree to defend and hold harmless Pacific MedicoLegal along with our members, officers, employees, contractors, and agents, and to provide indemnification for any claim, loss, liability, or expense, including reasonable attorneys' fees, arising out of your use of this site contrary to these terms, your submission of information you had no right to submit, or your violation of any law or court order.
We will notify you promptly of any such claim and may assume the defense. You may not settle a claim that creates an obligation or admission for us without our written consent.
11. Governing Law and Venue
California law governs these terms, without regard to conflict of laws principles.
Exclusive venue for any action relating to this website rests with the state courts of Los Angeles County, California, or the United States District Court for the Central District of California. Nothing here affects the jurisdiction of the Workers' Compensation Appeals Board or the venue provisions of a signed agreement.
12. Dispute Resolution
These website terms contain no arbitration clause, no class action waiver, and no jury trial waiver. Nothing on this page gives up a right you would otherwise have.
Raise a concern about this site with us first, using the details under section 15. Most concerns turn out to be a correction, and we would rather fix one than argue.
Dispute resolution provisions for an engagement, such as mediation or arbitration, appear within that engagement's written agreement. Those provisions get negotiated and signed, never forced through a website.
13. Changes
We may update these terms as our services or the law change, and we will update the "Last Updated" date above. Material changes get a note on this page.
Changes apply going forward. Continued use after the posted date means you accept them.
14. Severability and Entire Agreement
Should a court hold any provision unenforceable, that provision will be narrowed to the minimum extent necessary or severed, and the rest remains enforceable. Our failure to enforce a provision waives nothing. Headings serve convenience only.
With our privacy policy, these terms form the entire agreement between you and Pacific MedicoLegal covering your use of this website.
